The Contract Between Us

We must receive full payment for the goods you order before your order can be accepted. Once payment has been received, we will confirm acceptance of your order by sending an email to the address you provide in your order form. Our acceptance of your order creates a legally binding contract between us.

Our Right to Refuse Your Order

2.1 We reserve the right to refuse your order for any reason, including but not limited to:

  • 2.1.1 Insufficient stock to deliver the goods you ordered;
  • 2.1.2 Non-delivery to your area;
  • 2.1.3 Incorrectly listed prices due to typographical errors or supplier pricing errors.

2.2 If we refuse your order, we will notify you by email and re-credit any amount deducted from your credit card as soon as possible, but no later than 30 days from your order. We will not offer additional compensation for any disappointment suffered.

Price

3.1 The prices for goods you order are set out on our website.

3.2 You may need to pay extra for delivery, and we may not be able to deliver to some locations. Our delivery charges are detailed on our website.

3.3 All orders are processed in USD at the prices displayed at the time of order. Conversions into other currencies are approximate and for customer convenience only. These prices may change slightly between the order date and the dispatch date.

Your Right to Cancel Your Contract

4.1 You may cancel your contract for the goods ordered at any time up to the end of the 14th working day from the day after you ordered the goods. No reason is required, and no penalty will be charged.

4.2 To cancel, you must notify us in writing.

4.3 If you have received the goods, you must return them to our contact address at your own cost and risk. If the goods have already been processed for delivery, do not unpack them upon receipt and return them at your cost and risk as soon as possible.

4.4 Custom-made items, such as bespoke garments, are excluded from the usual return period and can only be returned if faulty or delivered in error.

4.5 Once you notify us of the cancellation, any sum debited from your credit card will be re-credited to your account as soon as possible and within 30 days of your order.

4.6 If you cancel but do not return the goods in the delivered condition or do not pay the return delivery costs, we may deduct the direct costs of recovering the goods from the amount to be re-credited to you.

Delivery of Goods to You

5.1 We will deliver the goods ordered to the address you provide at the time of order.

5.2 Delivery will be made as soon as possible after acceptance of your order and within 30 days of the order.

5.3 You become the owner of the goods upon delivery. Once delivered, the goods are at your own risk, and we are not liable for their loss or destruction.

Fraud Prevention

6.1 You agree that we may use personal information provided by you to conduct anti-fraud checks. This information may be disclosed to credit reference or fraud prevention agencies, which may keep a record of it.

6.2 We will validate the name, address, and other personal information supplied by you during the order process against appropriate third-party databases. By accepting these terms and conditions, you consent to such checks. No credit check is performed, and your credit rating will be unaffected. All information provided will be treated securely and in accordance with the Data Protection Act 1998.

Notices

Unless stated otherwise in these terms and conditions, all notices from you to us must be in writing and sent to info@bagpipesshop.com. All notices from us to you will be displayed on our website from time to time.

Events Beyond Our Control

We are not liable for any failure to deliver goods or any delay in doing so, or for any damage or defect to goods delivered, caused by events beyond our reasonable control, including but not limited to strikes, lock-outs, industrial disputes, system or network access breakdowns, floods, fires, explosions, or accidents.

Governing Law

The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between us.

Entire Agreement

These terms and conditions, together with our current website prices, delivery details, contact details, and privacy policy, constitute the entire agreement regarding the supply of goods to you by us. Except where you are dealing as a consumer:

10.1 Nothing said by any salesperson on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by us; and,

10.2 Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
